MotoVibes Travel Terms & Conditions for Guided Motorcycle Tours
Introduction
Motorcycle journeys and events organized by MotoVibes Travel are designed to provide maximum riding enjoyment and a memorable experience, with a focus on respect and camaraderie among participants. Participation in these journeys and events is subject to the following terms and conditions.

By participating, you acknowledge and accept that all activities are undertaken at your own risk. You further understand and agree that motorcycle travel inherently involves increased risks, including, but not limited to, accidents, injuries, and potential hazards associated with riding on rough or poorly maintained roads, remote areas far from immediate assistance, high-altitude mountainous terrain, and desert or wilderness environments. MotoVibes Travel cannot be held liable for any incidents or injuries resulting from these or other natural risks associated with motorcycle touring.

1. Booking and Participation Confirmation
The participant is legally bound by the booking request, confirmed through written acceptance from MotoVibes Travel. By submitting payment, participants agree to these terms and conditions. Services provided are based on the tour description and event documentation.

2. Participation Fee and Payment Terms
Participation fees are due as per the terms in the tour description or invoice and must be paid no later than 60 days before the start of the journey or event. Failure to make full payment by this deadline may result in cancellation of participation without refund of prior payments.
3. Cancellation and Refund Policy by MotoVibes Travel
MotoVibes Travel reserves the right to cancel or postpone tours for substantial reasons, such as low participation, up to four weeks before the start. In such cases, full refunds of the participation fee will be provided, excluding additional claims or compensation. In the event of force majeure as outlined in Clause 9, no refunds will be provided.

4. Participant Cancellation and Refund Policy
Participants may cancel their booking by providing written notice. Cancellation fees are as follows:
• Up to 60 days before the start: full deposit (typically 20%)
• Up to 30 days before the start: 50% of the participation fee
• 29 days or fewer, or in case of non-appearance: 100% of the fee

5. Third-Party Substitution
Participants may nominate a substitute to join the journey, subject to MotoVibes Travel's approval. The substitute must meet the required rider skill level for the tour, hold a valid motorcycle license (Category A or equivalent), and be approved no later than 30 days before the tour start date. Any additional administrative costs arising from the substitution are the responsibility of the original participant.

6. Guide Unavailability and Replacement Policy
If, for any reason, the designated Guide for a guided tour becomes unavailable within 29 days prior to the tour start date, MotoVibes Travel will make reasonable efforts to find a suitable replacement Guide. In the event that a replacement Guide cannot be found, the tour will proceed as a self-guided tour. In such cases, participants will receive a refund of the surcharge paid for the tour guide.

7. Health and Medical Emergency Policy
In the event of a medical emergency during the journey, the participant consents to MotoVibes Travel notifying emergency contacts or appropriate medical personnel as required. All emergency costs are the participant’s responsibility.

8. Code of Conduct for Participants
Participants are expected to conduct themselves respectfully towards local customs, laws, and other group members. Disruptive or dangerous behavior, including substance use while riding, may result in exclusion from the tour without refund.

9. Force Majeure and Contract Termination
In the event of force majeure — including but not limited to natural disasters, war, armed conflict, pandemic, or government-imposed travel restrictions — either party may terminate the contract without penalty. In such cases, MotoVibes Travel is not liable for any refund of payments already made. Participants are strongly advised to obtain travel cancellation insurance as outlined in Clause 18, which covers such unforeseen events.

10. Use of Photos and Videos
MotoVibes Travel retains the right to use photos and videos taken during events for promotional purposes. Participants may opt out by providing written notice before the journey.

11. Driver’s License Requirement
Only participants holding a valid motorcycle license (Category A or equivalent) may join the tour. Participants must present their license for verification prior to or at the start of the tour. MotoVibes Travel reserves the right to exclude any participant unable to provide valid proof of license, without refund.

12. Vehicle Condition and Participant Responsibility
Participants using their own motorcycles are solely responsible for ensuring the vehicle’s roadworthiness and compliance with all regulations. MotoVibes Travel reserves the right to inspect vehicles but is not responsible for their insurance. Participants who have rented motorcycles are responsible for checking and maintaining the vehicle’s good working order throughout the tour. Any costs arising from failure to ensure the motorcycle’s condition are the participant's responsibility.

13. Required Protective Gear
Participants are required to wear full protective motorcycle gear, including helmets, suits, boots, gloves, and necessary rain gear. MotoVibes Travel reserves the right to exclude participants who fail to comply.

14. Assumption of Risk and Participant Responsibility
Participants ride at their own risk and must adapt their riding style to the environment. By joining, they confirm they are in good health and capable of safely handling the tour’s physical demands. MotoVibes Travel is not liable for any incidents, injuries, or damages resulting from participation.

15. Conduct and Compliance During Tours
Participants must follow instructions from MotoVibes Travel representatives. Failure to comply may result in exclusion from the tour without refund, with participants bearing any return travel costs.

16. Responsibility for Motorcycle Transport in Case of Mechanical Failure or Accident
Participants are solely responsible for arranging and covering transport costs for their motorcycle in case of mechanical failure or accident. MotoVibes Travel advises participants to ensure their insurance includes transport and breakdown coverage.

17. Legal and Regulatory Compliance
Participants are responsible for adhering to all traffic and road regulations. MotoVibes Travel assumes no liability for violations, and participants must ensure they have liability and health insurance covering travel in Germany and abroad.

18. Recommended Insurance Coverage
Participants are required to obtain travel cancellation, accident, medical, and liability insurance prior to joining the tour, and must carry proof of insurance during the tour. MotoVibes Travel strongly recommends additional coverage for luggage, motorcycle breakdown, and transport. MotoVibes Travel accepts no liability for costs arising from a participant's failure to obtain adequate insurance coverage.

19. COVID-19 or Health Policy
Participants agree to comply with all health regulations applicable in the host country and any additional MotoVibes Travel requirements for health safety. This includes, but is not limited to, vaccination or health clearances required in response to any infectious disease outbreak, epidemic, or pandemic. Participants who are unable to join due to health-related travel restrictions are advised to claim through their travel cancellation insurance as outlined in Clause 18.

20. Adverse Weather and Program Changes
MotoVibes Travel is not responsible for adverse weather. No fee refunds will be provided due to weather. Program changes may occur, and MotoVibes Travel is not liable for disruptions from third-party services, such as transportation carriers.

21. Limitation of Liability
MotoVibes Travel’s liability is limited to the tour fee, except in cases of intentional or gross negligence. Liability for any loss of personal property or third-party provider actions is excluded where MotoVibes Travel is not directly at fault.

22. Jurisdiction and Governing Law
All disputes will be governed by German law, with Berlin as the place of jurisdiction.

23. Data Privacy and Information Sharing
MotoVibes Travel will collect and store participant information solely for coordinating the journey and ensuring participant safety. All data will be handled per applicable data protection laws.
